Prostitution Offenses
In Massachusetts, there are various ways in which a person can be charged with a prostitution crime. Everyone knows that it’s a crime to solicit a prostitute as well as to prostitute oneself. But there are other affiliations with prostitution that can lead to criminal charges, prison time, and sex offender registration.
Prostitution and Solicitation of a Prostitute* carries the following potential penalties in MA:
- 2 1/2 years in jail
- $1,000 fine
* A first conviction for this offense does not require registration with SORB.
Earning money or sharing earnings derived from prostitution** is a felony and carries the following potential penalties:
- Two years (minimum mandatory) state prison sentence, up to five years in state prison.
- $5,000 fine (mandatory)
In order to be convicted of this offense, the prosecution must prove beyond a reasonable doubt that you specifically knew that source of earnings was prostitution.
** A first conviction for this offense does not require registration with SORB.
Living off or sharing earnings of a minor prostitute*** is a felony and carries the following potential penalties:
- Mandatory Minimum 5 years in state prison
- $5,000 fine (mandatory)
In order to be convicted of this offense, the prosecution must prove beyond a reasonable doubt that you specifically knew that source of earnings was prostitution. It does not require, however, proof that you knew the prostitution was performed by a minor.

Enticing away a person for Prostitution or Sexual Intercourse**** is a felony and carries the following potential penalties:
- 3 years in state prison
- $1,000 fine
**** A conviction for this offense does require registration with SORB.
Inducing a Minor into Prostitution***** is a felony and carries the following potential penalties:
- 3 years in state prison (minimum mandatory) up to 5 years in state prison
- $5,000 fine (mandatory)
